What is Alternative Dispute Resolution?
Alternative dispute resolution (“ADR”) encompasses several forms of out-of-court negotiations including: mediation, arbitration, early neutral assessment, and collaborative divorce. By far the most common form of ADR is mediation.
Mediation is an out-of-court event where the parties and their lawyers meet at an agreeable location with a mediator who is a neutral third party. The mediator’s role is to facilitate agreements and concessions between the parties to arrive at an agreeable resolution. Parties are not forced to make agreements in mediation. Mediation takes less time and is therefore considerably less expensive than proceeding to a final hearing and also gives the parties a chance to craft a settlement on their own terms.
